2 for 1 Credit for People on Home Detention as a Condition of Probation . . .

In February of this year, the Indiana Supreme Court ruled that a defendant was entitled to credit time while on home detention as a condition of probation.

If you are currently on home detention as a condition of probation, before Peterlink v. State of Indiana, you were not entitled to 2 for 1 credit time. In Peterlink, the Indiana Supreme Court interpreted Indiana Code 35-28-2.5-5 and determined that people on home detention as a condition of probation (people sentenced to home detention as an executed sentence received 2 for 1 credit time) are entitled to 2 for 1 credit time as if they were serving an executed sentence. Because this case involves the interpretation of a statute, it applies retroactively.
